Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") form a binding agreement between you and PennyPresses ("PennyPresses", "we", "us", "our"), operator of the website at pennypresses.net and the related mobile applications and services (the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

PennyPresses helps pressed-penny collectors:

• Find pressed-penny machines on a map.
• Track and search their personal collection.
• Trade or sell pennies with other collectors through Trading Post and (when launched) Marketplace.
• Exchange pressed pennies by mail through the monthly Penny Pals club.
• Subscribe to PennyPresses Pro for unlimited collection storage, GPS map features, and other premium benefits.

We may add, change, or remove features at any time. We will give reasonable notice of material changes that affect paid subscribers.

3. Eligibility

You must be at least 13 years old to create an account and use the Service. If you are between 13 and the age of majority in your jurisdiction (typically 18), you may use the Service only with the involvement of a parent or guardian, especially for any feature that involves sharing your address (Penny Pals) or making payments (subscriptions, Marketplace).

By using the Service you represent that you meet these age requirements and that the information you provide about yourself is accurate.

4. Your account

You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Notify us immediately at support@pennypresses.net if you suspect unauthorized access.

You may close your account at any time by contacting us or by using any in-app delete-account feature. We may suspend or terminate accounts that violate these Terms or that pose a risk to other users.

5. Acceptable use

When using the Service you agree NOT to:

• Violate any applicable law or third-party right.
• Misrepresent your identity, age, or affiliation.
• Upload content that is illegal, harassing, defamatory, sexually explicit, hateful, threatening, or that infringes someone else's rights.
• Use the Service to spam, scam, harvest data, send unsolicited messages, or operate any automated bot or scraper.
• Interfere with the Service's security, attempt to access another user's account, or probe for vulnerabilities except through a coordinated disclosure to security@pennypresses.net.
• List counterfeit, stolen, or otherwise unlawful items in Trading Post or Marketplace.
• Use Penny Pals to send anything other than a pressed penny in a sealed envelope. No money, hazardous materials, drugs, weapons, or other regulated items.
• Reverse-engineer the apps, decompile binaries, or work around technical protection measures.

We may remove any content and suspend any account that violates this section.

6. Subscriptions and billing

PennyPresses Pro is offered as monthly or yearly subscriptions, and (when enabled) as a one-time "Remove Ads" purchase.

• On the website: Subscriptions are billed by Stripe or PayPal, at your choice. You provide payment details directly to those processors; we never see your full card number.
• In the iOS app: Subscriptions and one-time purchases are billed by Apple through your App Store account.
• In the Android app: Subscriptions and one-time purchases are billed by Google Play.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. The price displayed at checkout is the price that will be charged. We may change subscription prices with at least 30 days' notice; price changes apply to the next renewal.

7. Cancellations and refunds

You may cancel a subscription at any time:

• Subscriptions purchased on the website (Stripe / PayPal): cancel from the Profile page in the website. The cancellation takes effect at the end of the current billing period; you keep Premium access until then. We do not pro-rate or refund partial periods unless required by law.
• Subscriptions purchased through Apple or Google: must be cancelled in your device's subscription settings (iOS Settings → Apple ID → Subscriptions, or Google Play → Profile → Payments & subscriptions). Refund requests for App Store / Play Store purchases are handled directly by Apple or Google according to their refund policies.

If a subscription auto-renewed without your knowledge or consent, contact us within 30 days at support@pennypresses.net and we'll work with you and the relevant payment processor to make it right.

8. Your content

You retain ownership of the photos, notes, listings, and other content you upload ("Your Content").

By uploading Your Content you grant PennyPresses a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit Your Content as needed to operate the Service, and to display it to users you choose to share it with (for example, your matched Penny Pal, or buyers viewing your Marketplace listing). This license ends when you delete the content or your account, except for residual copies in backups (typically purged within 90 days).

You represent that you have the right to upload Your Content and that doing so does not violate any law or third-party right.

We do not pre-screen Your Content but may remove it at our discretion if it violates these Terms.

9. Penny Pals - extra terms

Penny Pals is a peer-to-peer mailing club. By enrolling you understand and agree that:

• Your name and full mailing address will be shared with the pal you are matched with each month, so they can address an envelope to you.
• The other pal's name and mailing address will be shared with you, similarly.
• You commit to mail one pressed penny per month to your matched pal.
• You will upload a photo of the addressed envelope as proof of mailing, and the photo may be reviewed by an administrator before the recipient is notified.
• PennyPresses does not handle the physical mail, does not insure or guarantee delivery, and is not responsible for misuse of address information by other users.
• Repeated failure to mail or other misuse may result in being banned from Penny Pals.

You may withdraw from Penny Pals at any time by contacting us; you will not be matched in subsequent rounds.

10. Trading Post and Marketplace - extra terms

Trading Post lets users swap pressed pennies (or related items) directly with other users, with no monetary exchange. Marketplace (when launched) lets users list items for sale at a fixed price.

By using Trading Post or Marketplace you understand and agree that:

• You are solely responsible for the legality, quality, accuracy, and shipping of items you list.
• You are solely responsible for any tax obligations that arise from your transactions.
• Disputes are between buyer and seller. PennyPresses may, but is not obligated to, mediate. Our mediation does not guarantee any particular outcome.
• You will not list counterfeit, stolen, recalled, or otherwise unlawful items.
• Your username, listings, and the messages you exchange with another user will be visible to that user.

11. Intellectual property

The PennyPresses name, the Rollie mascot, the website code, the app code, and all other materials we provide (excluding Your Content and third-party materials) are owned by us or our licensors and are protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purposes, subject to these Terms.

You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.

12. Third-party services

The Service integrates with third parties listed in our Privacy Policy. Their services are governed by their own terms and policies. We are not responsible for them.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if we believe you have violated these Terms, are causing harm to other users, are abusing our infrastructure, or where required by law. Where reasonable, we will give you advance notice and an opportunity to fix the issue.

Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENNYPRESSES DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT ANY CONTENT, INCLUDING USER-PROVIDED CONTENT, IS ACCURATE, COMPLETE, OR RELIABLE.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PENNYPRESSES AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud or gross negligence).

16. Indemnification

You will indemnify and hold harmless PennyPresses and its officers, employees, and agents from any claim, demand, or damages, including reasonable attorneys' fees, arising out of (a) Your Content, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any transaction you conduct with another user through Trading Post, Marketplace, or Penny Pals.

17. Governing law and disputes

These Terms are governed by the laws of the applicable laws of the operator jurisdiction, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or relating to these Terms or the Service must first be the subject of good-faith informal negotiation by emailing support@pennypresses.net. If the dispute is not resolved within 60 days, it must be resolved by the courts or dispute forum selected in these terms in the operator jurisdiction, unless applicable law requires a different forum.

You and PennyPresses each waive the right to participate in a class action.

18. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. For material changes we will give at least 30 days' notice in-app or by email. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, stop using the Service and close your account.
